1. Provider and acceptance

These Terms of Service govern your use of the resvp iOS application, the website at getresvp.app, and related services.

By creating an account, purchasing a subscription, or using resvp, you agree to these Terms. If you do not agree, do not use the service.

Any mandatory consumer rights that apply to you remain unaffected.

2. The resvp service

resvp is a location-based music discovery and social application. It may allow users to share music and moods associated with an approximate area, discover nearby content, maintain a profile, interact with content, communicate with other users, and access subscription-based functionality.

The exact features, availability, and presentation of the service may change over time.

resvp does not provide the underlying music-streaming service. Availability and playback of music may depend on Apple, music providers, rights holders, your region, your device, and any separate music subscription required by a third party.

3. Eligibility and account registration

You must be at least 16 years old to use resvp.

You must provide accurate information, keep your account information current, and protect access to your account and device.

You are responsible for activity performed through your account unless it results from circumstances for which you are not responsible. Notify us promptly at [email protected] if you suspect unauthorised access.

You may not create an account for another person without permission, impersonate another person or organisation, or create accounts to evade a suspension or ban.

4. Location awareness

resvp uses location-related functionality. When you share content, it may be associated with and displayed in an approximate geographic zone.

Although resvp is designed not to publicly display your precise coordinates, other users may still infer your approximate location from your shares, timestamps, profile, content, or surrounding circumstances.

Use location-based features carefully. Do not use resvp in a way that creates a danger while driving, cycling, walking, or engaging in any activity requiring your full attention.

5. User content

“User Content” includes profile information, images, shares, moods, comments, replies, messages, reports, and other material submitted through resvp.

You retain ownership of rights you hold in your User Content.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt for technical purposes, transmit, display, and make your User Content available to the extent necessary to operate, secure, improve, and provide resvp.

For public User Content, this licence includes displaying that content to other users through resvp. The licence ends when the relevant content is deleted from our active systems, except where continued processing is necessary for backups, legal compliance, security, enforcement, protection of other users, or the integrity of shared interactions.

You represent that you have the rights and permissions necessary to submit your User Content and allow us to use it as described in these Terms.

6. Music, artwork, and third-party rights

References to songs, artists, albums, artwork, previews, and streaming links may come from Apple or other third-party services.

Music and related materials remain the property of their respective rights holders. resvp does not grant you ownership of, or a licence to exploit, third-party music or artwork outside the functionality made available through the service.

You may not upload or distribute content that infringes copyright, trademark, privacy, publicity, or other rights.

7. Prohibited conduct

You must not use resvp to:

• violate applicable law or the rights of another person;
• threaten, harass, stalk, bully, exploit, or intimidate anyone;
• publish hate speech or content promoting violence or discrimination;
• share unlawful, defamatory, fraudulent, sexually exploitative, or seriously harmful content;
• sexualise or exploit minors;
• reveal another person’s private or precise location without permission;
• impersonate another person or misrepresent an affiliation;
• infringe intellectual-property, privacy, publicity, or data-protection rights;
• send spam, scams, unauthorised advertising, or repetitive unwanted communications;
• distribute malware or attempt to interfere with the security or operation of the service;
• scrape, harvest, reverse engineer, probe, or access the service through unauthorised automated means, except where a restriction is prohibited by mandatory law;
• manipulate engagement, counters, rankings, subscriptions, or other service functionality;
• evade access controls, blocks, suspensions, subscription requirements, or moderation measures; or
• encourage or assist another person in doing any of the above.

8. Reporting, blocking, and moderation

resvp may provide tools to report content or users and to block other users.

We may review reports and remove or restrict content, limit visibility, suspend functionality, issue warnings, preserve relevant evidence, suspend or terminate accounts, or notify competent authorities where reasonably necessary.

We are not obliged to monitor every item of User Content before publication. The availability of reporting or moderation tools does not guarantee that all objectionable content will be identified immediately.

To report unlawful or abusive content, use the in-app reporting function where available or email [email protected] with enough information to identify the content and explain the issue.

9. Subscriptions

Some or all use of resvp requires an active auto-renewable subscription purchased through Apple’s App Store.

At the effective date of these Terms, the German App Store offerings are configured as follows:

• Monthly subscription: €2.99 per month, with no free trial.
• Annual subscription: €19.99 per year, with a seven-day free trial for eligible users when Apple displays the offer during purchase.

Prices, currencies, taxes, and availability vary by country and may change. The price and terms displayed by Apple immediately before confirmation of the purchase are controlling.

The subscriptions are currently offered only in selected countries. Service or subscription availability in a particular country is not guaranteed.

10. Free trial

The seven-day free trial applies only to the Annual subscription and only if Apple determines that you are eligible and displays the trial in the purchase flow.

Eligibility may be limited, including for users who previously used an introductory offer within the same subscription group.

Unless cancelled before the end of the trial, the Annual subscription automatically converts into a paid annual subscription at the price displayed by Apple during purchase.

The Apple purchase screen provides the final applicable trial and billing information.

11. Billing, renewal, and cancellation

Payment is charged by Apple to the payment method associated with your Apple Account after you confirm the purchase or, for an eligible free trial, when the trial converts to a paid subscription.

Subscriptions automatically renew for the same subscription period unless cancelled through Apple before renewal, subject to the timing and terms shown by Apple.

You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the resvp app or deleting your resvp account does not cancel your Apple subscription.

Following cancellation, access generally continues until the end of the already-paid subscription period or until the end of a free trial, as determined by Apple.

Apple controls payment processing, renewal, billing recovery, cancellation, and App Store purchase records.

12. Refunds and statutory rights

Refund requests for purchases processed through Apple must generally be submitted to Apple using Apple’s available refund and support process.

Whether a refund is granted is determined by Apple and applicable law.

Nothing in these Terms excludes or limits mandatory consumer rights, including rights relating to defective digital services, statutory guarantees, or any right of withdrawal that cannot lawfully be excluded.

13. Subscription entitlement and RevenueCat

We use RevenueCat to receive and manage subscription entitlement information provided in connection with App Store purchases.

An active entitlement may depend on Apple’s transaction status and successful technical synchronisation. The “Restore Purchases” function can be used to request restoration of eligible App Store purchases.

14. Availability and changes to the service

We aim to provide a reliable service but do not guarantee uninterrupted, error-free, or permanently available access.

The service may be temporarily unavailable because of maintenance, security issues, third-party outages, technical failures, legal requirements, or events outside our reasonable control.

We may modify, add, or remove features where reasonably necessary to improve the service, maintain security, comply with law, respond to third-party changes, or develop the product.

Where a change materially disadvantages paying users, we will provide notice where required and respect applicable consumer rights.

15. Third-party services and links

resvp may interact with or link to services provided by Apple and other third parties.

Third-party services are governed by their own terms and privacy policies. We do not control their content, availability, eligibility rules, pricing, or technical operation.

We are not responsible for third-party services except to the extent liability cannot be excluded under applicable law.

16. Suspension and termination

You may stop using resvp at any time and may delete your account through the function provided in the app.

We may restrict, suspend, or terminate access if you materially or repeatedly violate these Terms, create legal or security risks, harm other users, fail to meet eligibility requirements, or misuse the service.

Where appropriate and legally required, we will consider the circumstances, severity, frequency, and impact of the violation and provide reasons or an opportunity to respond.

Immediate action may be taken where necessary to protect users, prevent abuse, comply with law, or address urgent security risks.

Account deletion or termination does not automatically cancel an Apple subscription. You must manage the subscription separately through Apple.

17. Intellectual property

The resvp service, excluding User Content and third-party materials, including its software, visual design, branding, text, and original materials, is protected by intellectual-property law.

Except as permitted by law or expressly authorised by us, you may not copy, modify, distribute, sell, license, or commercially exploit protected parts of the service.

18. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under mandatory product-liability law, and in other cases where liability cannot legally be excluded or limited.

For ordinary negligence involving a material contractual obligation, liability is limited to the foreseeable damage typical for this type of contract. A material contractual obligation is one whose fulfilment is essential to the proper performance of the contract and on which the user may ordinarily rely.

Subject to mandatory law, liability for ordinary negligence is otherwise excluded.

These limitations also apply to our legal representatives and agents.

Nothing in this section limits mandatory consumer rights.

19. Indemnification outside mandatory consumer law

To the extent permitted by applicable law, users acting for business or professional purposes agree to indemnify us against third-party claims arising from their unlawful User Content or culpable violation of these Terms.

This section does not impose an indemnification obligation on consumers where such an obligation would conflict with mandatory consumer law.

20. Changes to these Terms

We may update these Terms for valid reasons, including changes to the service, law, security requirements, or third-party platforms.

The updated version will be published with a revised effective date. Where required, we will give advance notice and request consent.

Changes will not retroactively remove accrued rights or override mandatory consumer protections.

21. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law of the country in which you have your habitual residence.

Mandatory statutory rules concerning jurisdiction remain unaffected.

22. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. Mandatory statutory law applies in place of the invalid or unenforceable provision.
